Standard Performer Terms & Conditions

These terms apply to any performance booking arranged through Buttermint (“the Agent”). By confirming a booking via email or other written or other forms of communication, the Artist agrees to the following terms.

Definitions

To keep things clear, here are the key terms used throughout this agreement. These definitions help everyone understand who’s responsible for what, and ensure there’s no confusion about roles, responsibilities, and expectations

  • The Agent: Buttermint, ABN 27 162 558 899, who acts as a booking facilitator between performers and event organisers.
     

  • The Artist: The band, musician(s), or representative accepting a booking facilitated by the Agent.
     

  • The Event: Any event for which the Artist is booked via the Agent.
     

  • The Client: The organisation or entity hosting the Event (e.g., Jane Smith Bride-to-be or 'Brooklyn Standard Venue' etc). and/or seeking entertainment services from the Artist.

Role of the Agent

This section outlines what we do (and don’t do). It clarifies our position as a booking agent – not an event organiser – so that everyone understands the scope of our involvement

The Agent acts solely as an administrative coordinator, responsible for:

  • Communicating between the Artist and the Client

  • Confirming booking details

  • Processing payment on behalf of the Client
     

The Agent is not the event organiser, employer, producer, promoter, or venue operator. The Agent has no control over the event environment, audience, production, or safety.

Booking Confirmation

Here’s how bookings are agreed upon. When you respond to confirm a gig via email or message, that becomes a binding agreement – so make sure you're across the details.

Specific booking details (date, time, location, set times, fees, etc.) will be provided in writing via email or text message. By replying to confirm a booking, the Artist agrees to those details and these general terms.

Payment

This explains how and when you’ll get paid. We handle payments on behalf of the client and aim to make the process smooth, timely, and transparent.

  • The Artist’s fee will be outlined in the booking email.
     

  • The Agent will issue an invoice to the Client for the agreed amount.
     

  • Once payment is received from the Client, the Agent will transfer the Artist's fee within 10 business days, provided a valid invoice has been submitted by the Artist.
     

Important Note: The Agent acts as a facilitator for payment but is not personally liable for delays or failures in payment by the Client. While every reasonable effort will be made to recover fees, the Artist acknowledges that in the event of unforeseen delays, non-payment, or insolvency on the part of the Client, payment to the Artist may be delayed or not received.

Cancellation

Sometimes things change. This section covers what happens if either party needs to cancel, and what we’ll do to help in those situations.

By the Artist:
If the Artist cancels after confirming a booking, they agree to make all reasonable efforts to secure a suitable replacement act of equivalent quality and professionalism.

  • No payment will be made to the Artist in the event of cancellation.

  • The Agent reserves the right to withhold future bookings from the Artist based on the circumstances and frequency of cancellations.
     

By the Client:

Cancellation terms may vary depending on the nature of the event:
 

  • Private Events (e.g. corporate functions, weddings):
    A deposit is typically secured at the time of booking to protect the Artist in the event of cancellation. In most cases, this deposit is non-refundable.

  • Public or Ongoing Bookings (e.g. bars, residencies):
    Deposits are not commonly used due to the frequency and informal nature of these bookings. These bookings are made in good faith, with the understanding that excessive cancellations may lead to the Agent discontinuing the working relationship with the Client.

In any cancellation scenario, the Agent will make reasonable efforts to secure full or partial compensation for the Artist. However, the Agent does not guarantee compensation and shall not be held liable if the Client refuses or is unable to pay.

Safety & Behaviour

Everyone deserves a safe and respectful work environment. This part explains expectations for conduct and who’s responsible for managing audience behaviour and safety.

  • The Artist agrees to behave professionally and comply with all event, venue, and legal requirements.
     

  • The Client is solely responsible for ensuring the safety and security of the performance environment, including audience management, security personnel (if required), and the overall conduct of attendees.
     

  • If the Artist feels unsafe or threatened — including but not limited to aggressive audience behaviour, inadequate security, or any foreseeable safety risk — they are entitled to pause or cease the performance until the issue has been addressed to their satisfaction.
     

  • The Artist is also within their rights to not begin the performance if the environment does not meet basic safety expectations.
     

  • The Agent is not liable for any incidents involving the venue, audience members, or third-party contractors.
     

  • The Agent will, however, support clear communication between parties and advocate for safe working conditions wherever possible.

Indemnity & Limitation of Liability

This section protects all parties by clarifying who’s accountable if things go wrong. It helps ensure no one gets unfairly blamed for things beyond their control.

The Artist agrees to hold the Agent harmless for any claims, damages, or losses arising from:

  • Injuries or incidents onsite

  • Event cancellation or changes

  • Issues with production, audience behaviour, or venue safety​

Governing Law

These terms are governed by the laws of the State of Queensland Australia

Agreement

By confirming a booking with the Agent via email or written message, the Artist acknowledges and agrees to these standard terms.
